Contested vs. Uncontested Divorces:
A contested divorce is one in which the husband and wife are in dispute regarding issues related to the marriage such as custody, child support, spousal support, and property division. If a divorce is contested, the court will ultimately decide how to resolve these issues instead of the parties.
On the other hand, an uncontested divorce is one in which the parties are in agreement with all issues related to the case, so there are no issues for the court to decide. The parties can enter into a property settlement agreement and file for a divorce without stepping foot in a courtroom. Even though a divorce is uncontested, the assistance of an attorney is recommended for individuals unfamiliar with the process.
Sometimes cases begin as contested divorces but can become uncontested after the issues are narrowed and both parties realize that settling the case is in everyone’s best interest. However, it is also possible for a divorce to begin as uncontested and become contested.
